At fintechs without a CRO, this usually sits with the Head of Compliance or VP of Engineering.

Risk Assessment and Classification

Transparency and Explainability

Where They Diverge: The 30% That Catches People

This is where a “NIST-only” approach falls short for global firms. The gaps are specific, enforceable, and consequential.

1. Conformity Assessments (EU AI Act Only)

EU AI Act Articles 16-17, 43: High-risk AI providers must conduct conformity assessments before placing the system on the market. For most financial services AI (credit scoring, insurance pricing), this is a self-assessment against Annex VII requirements — but it must be documented, maintained, and available to authorities.

NIST equivalent: None. NIST doesn’t require formal pre-market certification.

What to do: Layer a conformity assessment process on top of your existing model validation framework. If you’re already doing independent model validation per OCC Bulletin 2011-12 (Supervisory Guidance on Model Risk Management), you’re 70% there — add documentation of the EU-specific assessment criteria and a formal declaration of conformity.

2. EU Database Registration (EU AI Act Only)

EU AI Act Article 71: Providers of high-risk AI systems must register the system in the EU database before placing it on the market. This includes system purpose, status, any countries of use, and conformity information.

NIST equivalent: None. NIST recommends internal inventories but not external registration.

What to do: Maintain your AI model inventory (which both frameworks require) and establish a process to extract and submit registration data to the EU database for any model that touches EU customers.

3. Mandatory Incident Reporting (EU AI Act Only)

EU AI Act Article 62: Providers must report serious incidents to the relevant market surveillance authority. “Serious incident” means any incident that directly or indirectly leads to death, serious damage to health, serious disruption of critical infrastructure, or violation of fundamental rights.

NIST equivalent: NIST addresses incident response conceptually but doesn’t mandate reporting to specific authorities.

What to do: Extend your existing model risk event reporting process to include a trigger for EU authority notification when AI incidents meet the “serious incident” threshold. Define escalation criteria, reporting timelines, and responsible parties.

4. Prohibited Practices (EU AI Act Only — Already in Effect)

Since February 2, 2025, the EU AI Act has banned specific AI practices outright — including social scoring systems, untargeted facial recognition database scraping, emotion recognition in workplaces and schools, and manipulative AI techniques. NIST doesn’t address prohibitions.

Financial services firms should audit existing AI tools to confirm none fall into prohibited categories, particularly any AI used in HR or employee monitoring functions.

5. Mandatory Nature vs. Voluntary Adoption

This is the foundational divergence. NIST is guidance; the EU AI Act is law. Your U.S. regulators will reference NIST during exams — the GAO’s May 2025 report on AI in Financial Services (GAO-25-107197) confirmed that the OCC, Fed, and FDIC all point to existing model risk management and third-party risk guidance as applicable to AI, without mandating a specific framework.
